Every situation has its own details, and you should really ask the Dayanim familiar with your specific case. Generally speaking, since the mizbeach cries over each divorce we delay and try to resolve the issues as long as there is a sliver of a chance of reconciliation. Once the situation is beyond any hope, it is ona'a and lacking in v'ahavta l'rayacha k'mocha to hold someone hostage over financial and custody issues. These mitzvos apply even to ones ex and even if there are legitimate grievances.
